The U.S. Department of Labor recently issued guidance that significantly restricted the spectrum of activities that qualify as “agricultural labor” for purposes of H-2A labor certification and FLSA wage and hour compliance. Simultaneously, agricultural employers are increasingly vulnerable to organized labor’s concerted activities. Historically low unemployment rates and an ever-changing regulatory scheme dictate diligent action among agricultural employers.
