With nearly all of the cases regarding the 2020 Presidential election resolved, there is little to update this week. See below for information on two cases originating in Pennsylvania and Wisconsin.
- The case of Bognet v. Degraffenreid remains pending at the U.S. Supreme Court on a petition for writ of certiorari. Responses from Pennsylvania’s Secretary of State and the Democratic National Committee are due by March 15. At issue in the case is whether the Pennsylvania Supreme Court usurped the power of the Pennsylvania General Assembly by extending the absentee ballot receipt deadline. The appellants assert that the Pennsylvania Supreme Court’s ruling violated various provisions of the U.S. Constitution.
- In Trump v. Wisconsin Elections Commission, the U.S. Supreme Court denied former President Trump’s petition for writ of certiorari following adverse rulings in the federal courts below.
